  1. Starfish Software Product License, Limited Warranty, and Limitation

  4. This software is licensed to you for use by only one person at a
  5. time. You may copy this software for archive purposes, to protect
  6. your investment. You may also allow others to use this copy of the
  7. software, so long as it is used by one person at a time.  This
  8. software is protected by U.S. and international copyright law and
  9. cannot be copied or otherwise made available to more than one person
  10. at the same time, without violating the law. Giving or otherwise
  11. transferring all of your rights to the software to someone else will
  12. not violate copyright law, if you give all of the software and
  13. documentation (including this license) to that person. Remember, once
  14. you transfer your rights, you cannot continue to use the software or
  15. keep any copies of the software.

  19. To allow more than one person to use this software at the same time,
  20. you can purchase additional software for each person.

  22. Upgrades

  24. If this software is an upgrade version of software that you
  25. previously acquired, you have not acquired two different rights to
  26. use this software and its earlier version. This upgrade and the
  27. earlier version together constitute just one copy of the software and
  28. must be used by one person at a time (or transferred together to only
  29. one person).

  31. Other Limits on Your Use

  33. Except as described in this license, you may not transfer, rent,
  34. lease, lend, copy, modify, translate, sublicense, time-share,
  35. electronically transmit or receive, or decompile or reverse engineer
  36. this software or the media and documentation.

  38. Limited Warranty

  40. This product comes with "Philippe's Guarantee," which entitles you to
  41. a refund of the amount you actually paid, within 30 days of your
  42. purchase. Contact Starfish for details.

  44. Also, the physical media for this product provided by Starfish (if
  45. any) are guaranteed to be free of defects in materials and
  46. workmanship for 120 days from the date this product was originally
  47. purchased. If a defect occurs within this 120-day period, simply
  48. return the defective media to Starfish along with a dated proof of
  49. purchase, and Starfish will replace it free of charge.
  50. Starfish makes no representation or warranty regarding the content of
  51. this product, including its software and documentation. For example,
  52. Starfish does not warrant that the software or documentation are
  53. "error-free" or will meet the needs and requirements of a particular
  54. user. All information in the software and documentation is subject to
  55. change without notice. In addition, Starfish makes no representation
  56. or warranty regarding products, media, software or documentation
  57. manufactured or supplied by others.

  59. ALL OTHER WARRANTIES, REPRESENTATIONS, CONDITIONS, 
  60. EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY 
  61. OR CONDITION OF MERCHANTIBILITY OR FITNESS FOR A 
  62. PARTICULAR PURPOSE ARE DISCLAIMED BY STARFISH.  ALL 
  63. OTHER IMPLIED TERMS ARE EXCLUDED.

  65. Limitation of Liability

  67. The only remedy under this limited warranty or PhilippeÆs Guarantee
  68. is replacement of the defective media or refund of the actual amount
  69. paid. Starfish disclaims any liability for damages arising from the
  70. use of this product or any other damages, including (though not
  71. limited to) lost profits or data, special, incidental, or other
  72. claims, even if Starfish has been specifically advised of the
  73. possibility of such claims. Regardless of the form of the claim, the
  74. only liability Starfish will have to you or any other person will be
  75. limited to the amount actually paid for the product.

  77. Miscellaneous

  79. This license and limited warranty can only be modified in writing
  80. signed by you and an authorized officer of Starfish. If any part or
  81. provision is found to be unenforceable or void, the remainder shall
  82. be valid and enforceable. If any remedy provided is determined to
  83. have failed of its essential purpose, all limitations of liability
  84. and exclusions of damages shall remain in effect.

  86. Use, duplication or disclosure of this software and documentation by
  87. the U.S. Government is subject to the restricted rights applicable to
  88. commercial computer software (under FAR 52.227-19 and DFARS
  89. 252.227-7013). Sale of this software is subject to the U.S. Commerce
  90. Department export restrictions. This software is intended for use in
  91. the country in which Starfish sold it (or the EEC if first sold in
  92. the EEC).

  95. of California, U.S.A.
